Terms of Service

By downloading, installing, activating, or otherwise using Bosun, you agree to be bound by these Terms of Service and End User License Agreement ("Agreement"). If you do not accept these terms in their entirety, do not download or use the software. If you are acting on behalf of an organization, you represent that you have authority to bind that organization to this Agreement.

To use Bosun you must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater. The Software is intended for professional use by software developers. You may not use Bosun if you are prohibited from receiving software or technology services under the laws of your country or under applicable export control regulations (see section 16).

3. License Grant

Subject to payment of the applicable price and compliance with this Agreement, Bosun grants you a limited, personal, non-exclusive, non-sublicensable, non-transferable license to install and use the Software on the number of Macs specified by your plan:

This license is perpetual for the major version purchased (e.g., v1.x). Upgrades to a different major version (e.g., v2.x) may require a new license. Minor updates and patches within the same major version are included at no additional cost.

The license does not include: (a) the right to modify, adapt, or create derivative works of the Software; (b) the right to sublicense, sell, rent, lease, or transfer the Software or License Key to any third party; or (c) access to the source code.

4. Free Trial

Bosun includes a full-featured 14-day free trial with no payment information required. The trial begins automatically upon the first launch of the application. When the trial period expires, the Software stops functioning until activated with a valid License Key. No charges are made automatically at the end of the trial.

5. One-Time Purchase — No Subscription

Bosun is sold as a one-time, perpetual purchase. There are no subscription fees, annual maintenance charges, or recurring fees of any kind. The price paid at the time of purchase is the only charge associated with your plan, unless you choose to upgrade to a higher-tier plan or a new major version.

6. License Key Security

You are solely responsible for maintaining the confidentiality of your License Key. You must not share, publish, distribute, or transfer your License Key to unauthorized individuals. If you suspect your License Key has been compromised, contact us immediately at support@bosun.dev. Bosun is not responsible for any damages resulting from unauthorized use of your License Key by third parties.

7. Activation and Deactivation

To transfer a license to a new device, you must deactivate the Software on the previous device via the application settings or by contacting support. If a device is no longer available (e.g., loss or unrecoverable failure), contact us for assistance. Bosun reserves the right to audit the number of active activations at any time and to revoke fraudulent activations without prior notice.

If you activate the Software on a new device without first deactivating an existing one, and your plan has already reached its maximum number of active devices, the new activation will be automatically rejected. In that case, you must contact support to manually free the previous device; Bosun does not guarantee any specific turnaround time for this request and is not liable for any temporary inability to use the Software while the request is being resolved. This is not a defect of the Software.

8. Refunds

Bosun includes a full-featured 14-day free trial before any payment is required, which constitutes the user's evaluation period. Notwithstanding the foregoing, we offer a 14-day courtesy refund window from the date of purchase for justified requests, such as purchasing the wrong plan or an unresolvable technical defect. Refund requests outside this window will be assessed on a case-by-case basis. To request a refund, contact us at support@bosun.dev with the reason for your request. Refunds are managed and processed by Lemon Squeezy as merchant of record. EU customers: the statutory 14-day right of withdrawal for digital content (Directive 2011/83/EU) is considered exercised at the moment the user downloads the Software and begins the trial period, in accordance with Art. 16(m) of the Directive, provided that the user has been informed in advance and has given express consent.

9. Automatic Updates

Bosun may automatically download and install updates via the Sparkle framework. Updates may include bug fixes, performance improvements, and new features. You may disable automatic updates in the application's settings. We reserve the right to distribute critical security updates without prior notice and without the ability to be declined by the user, as such updates are necessary for the integrity of the Software.

10. System Access and User Responsibility

To perform its function, Bosun requests operating system permissions to read process information, network ports, Docker containers, SSH port forwards, and VPN configuration. This information is processed entirely locally and is not transmitted to external servers (see Privacy Policy).

The Software includes functionality to terminate operating system processes (kill). You are solely responsible for any action you take using this functionality. Terminating a process may cause loss of unsaved data, interruption of dependent services, or unexpected system behavior. Bosun shall not be liable under any circumstances for data loss, unsaved work, database corruption, service interruption, or any other damage resulting from use of Bosun's process termination features.

12. Third-Party Software

Bosun may incorporate open-source or third-party software components subject to their own licenses. Those licenses are not affected by this Agreement. A list of third-party components and their licenses may be requested at support@bosun.dev.

13. Intellectual Property

Bosun, including its source code, design, interface, logos, branding, and documentation, is the exclusive property of Bosun and is protected by copyright, trademark, and other applicable intellectual property laws. This Agreement does not transfer any intellectual property rights in the Software to you. The name "Bosun", the helm logo, and the "Bosun" mark are trademarks or unregistered trademarks of Bosun and may not be used without prior written authorization.

14. Indemnification

You agree to defend, indemnify, and hold harmless Bosun and its representatives, employees, and collaborators from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Software in violation of this Agreement; (b) your violation of any law or third-party rights; or (c) any data or process you terminate using the Software's features.

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR FREEDOM FROM ERRORS. WUNKWARE DOES NOT WARRANT THAT THE SOFTWARE WILL OPERATE WITHOUT INTERRUPTION, BE FREE FROM ERRORS OR SECURITY VULNERABILITIES, OR BE COMPATIBLE WITH FUTURE VERSIONS OF MACOS OR ANY OTHER THIRD-PARTY SOFTWARE OR HARDWARE.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WUNKWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, LOSS OF PROFITS OR REVENUE, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS INFORMATION, EVEN IF WUNKWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WUNKWARE'S TOTAL CUMULATIVE LIABILITY TO YOU, FOR ANY CAUSE AND UNDER ANY THEORY OF LIABILITY, SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE LICENSE IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so the above exclusions and limitations may not apply in full in your jurisdiction.

17. Termination

This Agreement is effective from the first use of the Software and remains in force until terminated. Bosun may terminate this Agreement and revoke your license immediately and without notice if you breach any of its provisions. You may terminate this Agreement at any time by uninstalling the Software and destroying all copies in your possession. Upon termination, all use of the Software must cease and all copies must be destroyed. Provisions that by their nature should survive termination (including intellectual property, indemnification, disclaimer of warranties, and limitation of liability) will remain in effect.

18. Export Controls

The Software may be subject to export control laws and regulations of the United States and other jurisdictions. You may not export, re-export, transfer, or make available the Software to any person, entity, or country sanctioned or restricted by competent authorities, including OFAC (U.S.) or the European Union. By using the Software, you represent that you are not located in an embargoed country and are not on any government agency's denied or restricted party list.

19. Force Majeure

Bosun shall not be liable for any delay or failure to perform its obligations resulting from causes beyond its reasonable control, including natural disasters, acts of government, internet infrastructure failures, cyberattacks, pandemics, or other force majeure events.

20. Assignment

You may not assign or transfer this Agreement or any of your rights or obligations hereunder without the prior written consent of Bosun. Bosun may assign this Agreement, in whole or in part, to a successor in the event of a merger, acquisition, reorganization, or sale of all or substantially all of its assets, without requiring your consent. Any prohibited assignment shall be null and void.

21. Dispute Resolution

In the event of any dispute arising from this Agreement, the parties agree to attempt to resolve it amicably through direct communication for a period of 30 days before initiating any formal legal action. To initiate the informal process, send a detailed notice to support@bosun.dev.

22. Governing Law and Jurisdiction

Nothing in this Agreement excludes or limits the mandatory consumer rights available to you under the laws of your country of habitual residence. The parties agree that, to the extent permitted by those mandatory rights and in the absence of mutual agreement or arbitration, any dispute that cannot be resolved amicably shall be submitted to the courts of competent jurisdiction as determined by applicable consumer protection law.

23. Severability

If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions of this Agreement shall continue in full force and effect.

24. Waiver

Bosun's failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Bosun.

25. Entire Agreement

This Agreement, together with the Privacy Policy and any applicable Enterprise agreement, constitutes the entire agreement between you and Bosun regarding the Software and supersedes all prior communications, representations, or agreements, whether oral or written, relating to its subject matter.

26. Changes to These Terms

We reserve the right to modify this Agreement at any time. If changes are material, we will publish the new version on this page with an updated date and, if we hold your email address, notify you at least 14 days before the changes take effect. Continued use of the Software after notification constitutes acceptance of the modified terms.
